The past week has seen a blizzard of Linux and
open-source related
news, most of it breaking in the last few hours.
Our top story: SCO filed a lawsuit on Tuesday
against Novell,
charging that Novell made a "bad faith effort to interfere
with
SCO's rights with respect to Unix and UnixWare."
Specifically, SCO objects to Novell's statements
that Novell, rather
than SCO, owns underlying intellectual property to
Linux.
I've become so frustrated by SCO's fight with the
Linux community
that I was actually cheered by the news that SCO had filed
another
lawsuit. This is not because I am fond of litigation
(although
litigation makes for good copy, it's bad for business), but
rather
because another lawsuit filed is another step closer to
actually
getting this matter resolved. I see a victory by SCO as being
highly
unlikely, but even a victory by SCO is better than waiting.
Meanwhile, as SCO seems determined to sue everyone
who sells Linux,
uses Linux, develops Linux (or has seen a Tennessee Tuxedo
cartoon),
Red Hat joined the ranks of vendors offering indemnification
to
customers who might get caught up in a lawsuit alleging abuse of
Linux
intellectual property. In previous weeks, IBM, Intel, the Open
Source
Development Labs (OSDL) and other vendors launched a defense
fund to cover
Linux customers' legal funds, and Hewlett-Packard
separately offered
indemnification to its customers in September.
And Novell completed its acquisition of SUSE, and
disclosed its
roadmap for improving the Linux distro. Plans include added
security
capabilities and support for proprietary enterprise
applications
such as Microsoft Outlook, Office, DB2 and SAP.
