1. EDITOR'S NOTE: SCO Gets More Bad News
SCO is in the news again this week, as a federal judge gave the
company 30 days to specify the damages it claims to have suffered
when Novell publicly challenged SCO's claim that it owned the
copyright to Unix code that allegedly became a part of Linux.
The SCO-Novell lawsuit is an offshoot of SCO's original lawsuit
against IBM, which claimed that Unix owns copyright to Unix code
that IBM wrongly included in Linux. When Novell claimed that it,
not SCO, owned the copyrights, SCO sued Novell.
In addition to demanding the additional specifics from SCO, a
U.S. judge last week denied Novell's motion to dismiss the suit
and SCO's motion to move the case to state court.
SCO posted a nearly $15 million loss in its second fiscal
quarter, as users are slow to sign up for its SCOsource licensing
program. SCOsource is a program that allows Linux users to buy
Unix licenses from Novell; the company took in a startlingly
small $11,000 revenue in the second quarter.
But the company said it has enough cash to continue its
intellectual-property litigation for several years.
SCO executives said it has a $48 million war chest to fight
lawsuits against IBM, Novell, Red Hat, and customers AutoZone and
DaimlerChrysler.
In other legal action, SCO sought a five-month postponement of
its trial against IBM until September 2005.
